Public AI can waive privilege.

In February 2026 a federal court held that documents a party created with a consumer AI tool, then shared with counsel, were protected by neither attorney-client privilege nor work product. The prompts became evidence.

A care team risks a reportable breach. A patient trying to understand their own results hands them to a model that may keep and train on them. Either way, the help goes unused because the cost of exposure is too high.
